The first & foremost requirement for a new project is Land. Land can be purchased or can be taken on lease. Stamp Duty is payable in both the cases. Huge projects require huge capital investment in which value of land have the major portion. The quantum of stamp duty depends upon the value of Land. Thus, stamp duty needs to be reimbursed or exempted.
In order to remove above burden of stamp duty on developer of project, the UP Government has come up with a scheme in which there is a scope for exemption in stamp duty payable on purchased/leased land.
Stamp Duty Exemption :
Eligible Projects would get this subsidy before commencement of commercial operations.
Quantum of Stamp Duty Exemption :
Exemption of Stamp Duty shall be provided –
- @ 100%
- On Land purchased or,
- On Land taken on lease for at least 10 years,
- For setting up Logistics Park & Dry Port Project anywhere in UP.
Note : Above Exemption shall be provided on submission of Bank Guarantee of equivalent amount of the exemption to Stamp & Registration Department.
Facilities eligible for stamp duty incentive :
Logistic Parks providing –
- Logistic facilities such as cargo segregation, sorting, grading, etc.
- Infrastructure facilities such as public transportation, communication facilities, etc.
- Business & commercial facilities such as health centres, Petrol Pumps, EV Charging Stations, etc.
Dry Ports providing –
- Services such as handing/clearance of containers under custom control.
Eligible Dry Port & Logistic Park Project :
Eligible Entities to avail Stamp Duty Exemption :-
- Proprietorship,
- Partnership firm,
- Cooperative Society, Company, Trust,
- Non-Government Organization
- Limited Liability Partnership
Period of Applicability of Scheme:
The Policy will be applicable for period of 5 years from the date of its notification.
